Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the TellyTale mobile application (the "App") operated by Techstack sp. z o.o., a company registered in Poland ("Company," "we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

The App is intended for use by adults aged 18 or older.

By using the App, you represent that:

  • You are at least 18 years old.
  • You are a parent, guardian, or authorized caregiver.
  • You have legal authority to agree to these Terms.

Children may access content only under parental supervision.

2. Scope of the Service

TellyTale is a mobile application that enables parents and caregivers to:

  • Generate AI-assisted personalized bedtime stories
  • Replay previously generated stories
  • Access narrated audio content
  • Record voice samples for synthetic narration (where available)
  • Store and manage stories within their account

We may modify, add, or remove features at any time.

The App is intended as a storytelling assistance tool. It does not replace parental supervision or judgment.

3. Accounts and Child Information

Certain features require account creation.

You agree to:

  • Provide accurate information
  • Maintain confidentiality of login credentials
  • Be responsible for all activity under your account

Child Profiles

You may create child profiles including:

  • First name
  • Age or reading level
  • Optional interests

By entering child information, you confirm that:

  • You are the child's legal guardian or authorized caregiver.
  • You consent to the processing of this information for story personalization.

We do not knowingly collect unnecessary personal data from children.

4. Payments and Subscriptions

The App may offer free and paid features.

All payments are processed exclusively through:

  • Apple App Store (iOS)
  • Google Play (Android)

Billing

  • Paid features may be offered via auto-renewing subscriptions.
  • Subscriptions automatically renew unless canceled via your App Store or Google Play account.
  • We do not control or store payment details.

Cancellation

You may cancel subscriptions through your Apple or Google account settings.

Refunds are governed solely by Apple or Google policies.

5. Voice Recording and Synthetic Voices

The App may allow users to record voice samples for the purpose of generating synthetic narration.

By choosing to use this feature and recording a voice sample, you confirm and agree that:

  • You have the necessary rights and authorization to use the recorded voice
  • You are not impersonating any individual without proper consent
  • You understand that the recorded voice data will be processed to generate synthetic narration within the App
  • You consent to such processing as described in our Privacy Policy

Use of voice features is entirely optional.

Voice recordings:

  • Are encrypted in transit and at rest.
  • Are used solely to generate narration within your account.
  • May be deleted through account settings.

5a. Voice Input (Speech-to-Text)

The App may allow users to provide optional voice input (for example, dictating story ideas), which is converted into text.

By using this feature, you agree that:

  • Your voice input may be processed to convert speech into text
  • The resulting text may be used within the App to generate or customize content

Use of this feature is entirely optional.

6. Acceptable Use

You agree not to:

  • Generate unlawful, violent, explicit, or harmful content.
  • Attempt to bypass moderation safeguards.
  • Clone voices without consent.
  • Reverse engineer or exploit the App.
  • Use the App for commercial resale without permission.

We reserve the right to suspend or terminate accounts for violations.

7. AI-Generated Content

Stories are generated using artificial intelligence systems.

While we implement moderation safeguards:

  • We do not guarantee accuracy or completeness.
  • AI output may contain unintended errors.
  • Parents remain responsible for reviewing content before sharing with children.

8. Intellectual Property

Your Content

You retain ownership of:

  • Child profile data
  • Story prompts
  • Voice recordings
  • Generated stories within your account

You grant us a limited, non-exclusive license to process such content solely to operate the App.

Company Property

All software, algorithms, models, branding, and system architecture remain the exclusive property of the Company.

You may not copy, distribute, or commercially exploit the App without written permission.

9. Data Retention

We retain:

  • Account data while your account remains active.
  • Generated stories unless deleted by you.
  • Voice recordings until deleted.

We may retain limited metadata for legal or compliance purposes.

You may request account deletion via Settings.

10. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE."

We disclaim all warranties including:

  • Fitness for a particular purpose
  • Non-infringement
  • Error-free operation
  • Continuous availability

Use of the App is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the amount paid by you in the 12 months preceding a claim.

Nothing in these Terms limits liability that cannot legally be excluded.

12. Termination

We may suspend or terminate your account if you:

  • Violate these Terms
  • Abuse voice cloning features
  • Engage in fraudulent activity

You may delete your account at any time.

Termination does not entitle you to refunds for completed billing periods.

13. Changes to the App or Terms

We may modify:

  • Features
  • Pricing structures
  • These Terms

Material changes will be communicated through the App or website.

Continued use constitutes acceptance of updated Terms.

14. Governing Law

These Terms are governed by the laws of Poland, subject to mandatory consumer protection laws applicable in your country of residence.
